Records Code (Section 410 ILCS 535/23-25 of the Vital Records Act and Title 77 Illinois Administrative Code, Illinois Vital Records Code, Chapter 1, subchapter e, Part 500.20, Part 500.70) BIRTH, DEATH, AND MARRIAGE INDEXES in the custody of the county clerk, prior to January 1, 1916, are the only indexes that may be viewed by the public. It is unlawful for any custodian of vital records to permit inspection of, or to disclose information contained in, vital records, or to copy or permit to be copied, all or part of any such record except as authorized by this Act or regulations adopted pursuant thereto. Any custodian who willfully and knowingly violates the provisions of Section 24 or 25 of the Act is guilty of a Class 4 felony. No copies of indexes can be made. Indexes of some birth and death records are available for inspection in the Illinois State Archives reference area, Illinois Regional Archives Depositories, and other libraries. Those must first ic approved by the Illinois State Registrar and the Director of the Illinois State Archives. These indexes only have births of 100 years old or older, deaths 50 years old or older, and marriage records 75 years old or older. CIRCUIT CLERK Wills, Probate, and divorces as well as all court records can be obtained from the circuit clerk. They request that you send a SASE with only one request per time.
