In the matter of Petition for Sale of Real Estate in the
Estate of Ignatious Atchinson, deceased.
William Carpenter being first duly sworn according to law says that
he is Administrator of the Estate of Ignatious Atchinson deceased,
That Samuel Atchinson, Arzilla Atchinson, Harriet Marlow, James Marlow,
Nace Allen, Albert Wyllys [Willis] and Nancy Wyllys [Willis] defendants
are nonresidents of the State of Illinois, that Samuel Atchinson and
Arzilla Atchinson resides in some part of the State of Orregon, That he
has not been able after due and diligent inquiry to learn the Post Office
address of Harriet Marlow and James Marlow but thinks they reside some
where in the State of Texas, Nace Allen resides at some point in the State
of California, Albert Wyllys and Nancy Wyllys both live in the State of
Texas but after due and diligent inquiry he has been unable to ascertain
their Post Office address of either of said defendants. He therefore asks
that service he had upon said nonresidents by publications as per the Stature
Law of the State of Illinois.

And your petitioner further represents that the said Ignatious Atchinson
died seized in fee of certain real estate in said County described as follows;
to-wit: The North West Quarter of the North East Quarter of Section Six in Township
Four South of Range Four East of the 3rd P. M. in Jefferson County, State of Illinois.
That the said deceased left him surviving Kizzire Atchinson his widow and Samuel
Atchinson and his wife Arzilla Atchinson, Thompson Atchinson and his wife Luvina
Atchinson, Barton Atchinson and his wife Evaline Atchinson, Ignatious Atchinson and
his wife Mira Atchinson, Winnie Allen and John Allen her husband, Harriet Marlow and
James Marlow her husband, and he left grandchildren entitled to inherit his estate
as follows: Nace Allen, Eldorus Allen and Sarah Allen his wife, Joseph Allen and
Fanny Allen his wife, Harriet Picket and W. G. Picket her husband, Ada Marshall
and Wright Marshall her husband, Zenova Campbell and Joseph Campbell her husband,
Mary Marshall and George Marshall her husband, Albert Wyllys Willis and Nancy Wyllys
Willis.
That Albert Wyllys and Nancy Wyllys are minors and under the legal age.
He further states that Samuel Atchinson and his wife Arzilla Atchinson, Harriet
Marlow and her husband James Marlow, Nace Allen, Albert Wyllys and Nancy Wyllys
are nonresidents of the State of Illinois.
Therefore and in consideration of the premises above stated your petitioner prays
that this Court may appoint some discreet person as Guardian ad litem for said minor
heirs to appear for them and defend their interest therein.
And that this Court will order and direct your petitioner to sell the said
real estate according to law or so much thereof as may be necessary to pay the debts
of said estate and to make such other and further order herein as the Honorable
Court may think well and propper.

GREETING: We COMMAND YOU, that you summon Kizzire Atchinson,
Samuel Atchinson, Aurzilla Atchinson, Thomas Atchinson, Lavina Atchinson,
Barton Atchinson, Evaline (Perlina) Atchinson, Ignatious Atchinson, Myra Atchinson,
Winnie Allen, John Allen, Harriet Marlow, James Marlow, Nace Allen, Eldorus Allen,
Sarah Allen, Joseph Allen, Fannie Allen, Harriet Pickett, W. G. Pickett, Ada Marshall
(Franklin County), Wright Marshall, Zenova Campbell, Joseph Campbell, Mary Marshall,
George Marshall, Albert Willis and Nancy Willis
If they shall be found in your County, personally to be and appear before the
County Court of said Jefferson County, on the first day of the next term thereof,
to be holden at the Court House in Mt. Vernon, in said Jefferson County, on the
Sixth day of April 1891 to answer unto the petition of William Carpenter Administrator
of the Estate of Ignatious Atchinson deceased, on the return day hereof; which said
petition was filed in our said Court, on the 24th day of January A. D. 1891, and prays
that this Court will order and direct the sale of Real Estate of said deceased for
the payment of debts.
And have you then and there this writ, with an
endorsement thereon, in what manner you shall have executed the same.

Marshall. The following names are not served with summons Samuel Atchinson,
Aurvilla Atchinson, Harriet Marlow, James Marlow, Nace Allen, Albert Wyllys

William Carpenter, Administrator of the Estate of Ignatius Atchison, deceased,
vs.
Samuel Atchison, et al.
Petition to sell real estate to pay debts.
Affidavit of the non-residence of Samuel Atchison, Aurzilla Atchison, Harriet Marlow,
James Marlow, Nace Allen, Albert Wyllis and Nancy Wyllis, defendants above named, having
been filed in the Office of the clerk of the County Court of Jefferson County, notice is
hereby given to the said defendants above named that the said plaintiff, William Carpenter,
administrator of the estate of Ignatius Atchison deceased, has filed his petition in the
said County Court of Jefferson county for an order to sell the premises belonging to the
estate of said deceased, or so much of it as may be needed to pay the debts of said deceased,
and described as follows, to-wit: The northwest quarter of the northeast quarter of section
six in township four south of range four east of the third P. M., in Jefferson County, State
of Illinois, and that a summons has been issued out of said Court against you, returnable
at the April Term, A. D. 1891, of said Court, to be holden on the sixth day of April, A. D.
1891, at the County Court House in Mt. Vernon, in Jefferson County, Illinois. Now, unless
you, the said defendants appear before said County Court of Jefferson County, on the first
day of a term thereof, to be holden at Mt. Vernon in said county, on the sixth day of April,
1891, and plead, answer or demur to the said complainant’s petition filed therein, the same
and the matters and things therein, charged and stated will be taken as confessed and a decree
entered against you according to the prayer of said bill.
