THE LAST WILL AND TESTAMENT OF SAMUAL A. PATTERSON I, Samual A. Patterson, being of the age of "65" and being of sound mind and memory, do hereby make, publish and declare, this my Last Will and Testament, in manner following, that is to say: FIRST: - It is my Will that my funeral expenses and all of my just (debts) be fully paid. SECOND: - I give and bequeath to my beloved Wife, Tennessee B. Patterson, all of my personal property of whatever kind, including money, notes, bills, accounts and choses(?) in action and other evidence of indebtedness, live stock and farming implements, to be hers absolutely; but I desire that my Executor hereinafter named, shall sell at public sale, all such personal property as my said Wife may not desire to keep in kind. And after paying all of my funeral expenses and debts, said Executor shall turn over the proceeds of such sale to my said Wife. THIRD: - I, hereby give and devise to my said Wife all the Real Estate of which I may die seized, wherever situated, to manage and control and to enjoy the rents, issues and profits arising therefrom, for and during her natural life; and at the death of my said Wife, I give and devise all of the said Real Estate to my Two Daughters, Luciele Patterson Dewey, and Helen Patterson, share and share alike; it being my express desire that my said daughters shall come into complete ownership, possession and control of the said Real Estate, immediately upon the death of my said Wife; but in case either of my said daughters shall die without issue, before the death of my said Wife, then, and in that event, I give and devise all of said Real Estate to the surviving Daughter. LASTLY: - I hereby nominate and appoint my friend, E.M. Walker, to be the Executor of this my last Will and Testament, hereby revoking all former Wills by me made. In Witness Whereof, I have hereunto set my hand and seal, the 12th day of April, A.D. 1909. S.A. Patterson, (Seal) The foregoing Instrument, consisting of one sheet was now here subscribed by Samuel A. Patterson, the Testator, in the presence of each of us, and was at the same time declared by him to be his Last Will and Testament, and we at his request sign our names hereto in this presence as attesting Witnesses. PERSONALLY APPEARED, in open Court, J.W. Patterson and A.C. Millspaugh, subscribing Witnesses to the foregoing Instrument, of writing, purporting to the Last Will and Testament of S.A. Patterson late of Jefferson County, deceased, who, being duly sworn according to law, do depose and say, each for himself, that the foregoing is the Last Will and Testament of the said S.A. Patterson, deceased; That they subscribed their names there to as the attesting witnesses at the request of the said Testator and in his presence, and in the presence of each other, on the 12th day of April, A.D. 1909, That he then and there subscribed his namethereto in our presence, and declared the same to be his Last Will and Testament; And that the said Testator at the time of executing the same as aforesaid was of full age, of sound mind and memory, and under no constraint.
