THE LAST WILL AND TESTAMENT OF ELI A. WINESBURGH
I, Eli A. Winesburgh, of the town of Casner, County of Jefferson and
State of Illinois,
declare this to be my Last Will and Testament, hereby revoking all former
wills.
1. I give and bequeath to my wife, J.J. Winesburgh, after paying all
my legal debts, all
my remaining personal property. I also give and bequeath to my said wife,
J.J. Winesburgh
all my real estate during her natural life.
2. After the death of my wife, I give and devise to my son Shelie Winesburgh,
the following
described real estate to-wit: the South West fourth of the South East quarter,
also the North
West corner of the South East fourth of the South East quarter, commencing
at the North
West corner of the South East fourth of the South East quarter running
East thirteen and
one-half rods, thence running South West along the East side of the creek
to intersect the
line running South from said North West corner and about fourteen rods
from said corner,
thence running North to the place of beginning, all in Section thirty-five
(35), town two (2),
Range one (1), East of the 3rd Principal Meridian, situated in the County
of Jefferson, State
of Illinois, upon the following conditions: that my said son, Shelie Winesburgh
shall see after
his mother and provide for her, keep her in fuel, and see that the farm
is kept in good order,
during her life time, if he, my said son Shelie Winesburgh, shall fail
at any time to discharge the
conditions set forth in this instrument, then after the death of my wife
the above described real
estate shall be equally divided between my children.
3. To my daughters, Iona Cook, Maria Cooper and Minnie Schmidt, I give
and devise the
remaining part of my real estate, to-wit: the South East fourth of the
South East quarter,
Section thirty-five (35), town two (2), Range one (1), East of the 3rd
Principal Meridian,
situated in the County of Jefferson, State of Illinois, less the part which
I give and devise to
my son Shelie Winesburgh, to be equally divided, share and share alike.
4. I appoint my son Shelie Winesburgh and E.C. Schmidt Executors of
this my last will and testament.

this thirty-first day of August 1905.

subscribing witnesses to the foregoing instrument of writing, purporting
to the Last Will and
Testament of E.A. Winesburgh, late of Jefferson County, deceased, who,
being duly sworn
according to law, do depose and say, each for himself, that the foregoing
is the Last Will and
Testament of the said E.A. Winesburgh deceased; that they subscribed their
names thereto as
the attesting witnesses at the request of the said Testator and in his
presence and in the presence
of each other, on the 1st day of August A.D. 1905. That he then and there
subscribed his name
thereto in our presence, and declared the same to be his Last Will and
Testament; and that the
said Testator at the time of executing the same as aforesaid was of full
age, of sound mind and
memory, and under no constraint.
Subscribed and sword to in open Court, this 29th day of April, A.D.
